Terms & Conditions
1. Scope and validity of the terms
1.1. The conditions apply to the legal relationships between the person (hereinafter the Customer) and the owner of the shopping environment www.pharmalead.ee (hereinafter the e-shop) Medivar OÜ (hereinafter the Seller) when purchasing products via the e-shop.
1.2. In addition to these terms and conditions, the legal relationships arising from the purchase of products through the e-shop are regulated by the legislation in force in the Republic of Estonia.
2.1. Product prices are in euros and include 20% VAT.
2.2. Product prices and availability may change without notice.
2.3. The images of the products in the online store are for illustrative purposes and may differ from the actual products (minimal and depending on the display settings).
3. Forming the order
3.1. To order the goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate method of product delivery. The amount of the fee is then displayed on the screen, which can be paid securely through the following payment methods:
• Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank
• Visa/Mastercard card payments
• With invoice
NB! When paying with a bank link, be sure to press the “Back to the merchant” button on the bank’s page.
Payments are mediated by Montonio Finance OÜ. Payment takes place outside the Webshop in a secure environment – when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of Montonio Finance OÜ. The seller does not have access to the customer’s bank and credit card data. The contract enters into force from the receipt of the amount to be paid to the current account of the Online Store.
Medivar OÜ is the responsible processor of personal data and forwards the personal data necessary for making payments to the authorized processor Montonio Finance OÜ.
4. Delivery of products
4.1. Free delivery of www.pharmalead.ee e-store products to mailboxes within Estonia from a purchase amount of €50. Courier service within Estonia €5.59
4.2. Delivery time is 1-5 working days.
4.3. Products are delivered to the Customer by Smartpost, DPD or Post24 parcel machine, courier or Eesti Post registered letter.
4.4. The customer is obliged to check the correctness of the provided contact information before placing the order, in order to avoid delays and misunderstandings in the delivery of the products. The seller is not responsible for the delay in the delivery of the products and the misunderstandings that have arisen if the delay or misunderstanding is due to the inaccuracy or incorrectness of the data provided by the customer when placing the order.
4.5. The customer becomes the owner of the goods after paying for them.
5. Right of return 14 days
5.1. The customer has a 14-day right of withdrawal from the contract (hereinafter 14-day right of return) for the goods purchased from the e-shop, in accordance with the terms of the contract below.
5.2. By purchasing from the e-store, the Customer agrees to the following conditions for using the right of return:
5.2.1. The product to be returned must be unused and in its original packaging (the customer must open the product’s original packaging carefully and without damaging it. If the packaging cannot be opened, the returned product does not have to be in its original packaging).
5.2.2 If the goods have been used for purposes other than what is necessary to verify the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.
5.2.3 To return the product, please fill out the withdrawal form. The application should be submitted to the address firstname.lastname@example.org in order to agree on further actions. The product can be physically returned by contacting our office at Laki 30 in advance or using SmartPOST, DPD or Omniva parcel machines.
5.2.4 We will return the money for the returned product to the Customer’s bank account within 14 days of receiving the withdrawal statement. Return shipping costs are the responsibility of the buyer.
5.3. The 14-day right of return does not apply, among other things, to items that are not eligible for return for health protection or hygiene reasons, if the package has been opened after delivery (e.g. cosmetics, underwear and bikinis, face masks).
The 14-day right of return is stipulated by legislation and is not a special feature of the www.pharmalead.ee e-shop. You can read more about the right of return on the website of the Consumer Protection and Technical Supervision Board.
5.4. If the customer does not go to the parcel machine within the time specified (by the transport company) and the product is returned to the Seller, the customer must pay the postal fee again to receive the product again. When abandoning the goods, the part of the transport fee will not be refunded.
6. Sales guarantee
6.1. Garantii andjaks on Medivar OÜ aadressiga Laki 30, 12915, Tallinn.
6.2. Garantiist tulenevate õiguste kasutamiseks pöörduda Medivar OÜ poole (pharmalead.ee email@example.com; +372 6606070).
6.3. Garantii annab tarbijale õiguse nõuda müüdud asja garantiis ettenähtud tingimustel tasuta või tasu eest parandamist või väljavahetamist. Tasuta ei hüvitata garantii korras tooteid ja detaile, mis on kulunud, lõhutud liigset jõudu kasutades, purunenud kukkudes või saanud kahjustada tulenevalt mittesihtotstarbelisest kasutamisest. Tasuta hüvitatakse tootjapoolse puudusega toote vastavusse viimine lepingutingimustes ettenähtuga. Puuduse tekkimise põhjuse selgitab välja tootja või müüjapoolne asjatundja. Toote garantiisse saatmise kulud hüvitab garantii andja.
6.4. Garantiist tulenevate õiguste kasutamiseks pöörduda garantii andja poole.
6.5. Garantii kehtib kaks aastat. Garantiitähtaeg algab asja ostjale üleandmisest ning peatub ajal, mil ostja ei saa asja kasutada lepingutingimustele mittevastavuse tõttu, mille eest vastutab garantii andja.
6.6. Garantii kehtib Eesti Vabariigis ja teistes Euroopa Liidu liikmesriikides.
6.7. Lisaks garantiist tulenevatele õigustele on tarbijal ka muud seadusest tulenevad õigused (nt kaebuse esitamise õigus VÕS §-s 218 sätestatud tingimustel).
7. Liability and force majeure
7.1. The Seller and the Customer are responsible to each other for the damage caused to the other party by violating these terms and conditions in the cases and to the extent stipulated in the legislation in force in the Republic of Estonia.
7.2. The Seller is not responsible for damages caused to the Customer or for the delay in product delivery if the damage or the delay in product delivery is due to a circumstance that the Seller could not influence, did not foresee and could not foresee (force majeure).
8. Processing of personal data
8.1. Tarbija annab veebipoes andmeid sisestades ja vastava kinnitusega õiguse koguda ja töödelda Tarbija isikuandmeid (nimi, kontakttelefon, paki kättetoimetamise ja/või kodune aadress, e-postiaadress) ning edastada logistikapartnerile isikuandmeid kauba kohaletoimetamiseks.
8.2. E-poel on õigus kasutada Tarbija elu- või asukoha aadressi reklaami ja muu informatsiooni edastamiseks Tarbijale.
8.3. Tarbijal on igal ajal õigus keelata oma isikuandmete kogumine ning kasutamine, välja arvatud juhul, kui see on vajalik lepingust tuleneva nõude sissenõudmiseks või kauba kohaletoimetamiseks.
8.4. Elektrooniliste isikuandmete kasutamine otsepostituseks toimub ainult siis, kui Tarbija on selle jaoks andnud eraldi nõusoleku.
8.5. Krüpteeritud andmeside pankadega ostude eest tasumisel tagab Tarbija personaalsete pangatunnuste turvalisuse ja neile puudub ka Veebipoel ligipääs.
9. Claim submission procedure
9.1. The online store is responsible for the non-compliance of the goods sold to the Consumer with the contract conditions or defects that appear within two years from the handing over of the goods to the Consumer. Within the first six months from the delivery of the item to the buyer, it is assumed that the defect was already present at the time of delivery of the item. It is the Webshop’s responsibility to refute the corresponding assumption.
9.2. In the event of a defect, the consumer has the right to contact the online store within two months at the latest, presenting the invoice on the basis of which the purchase of the goods was paid for.
9.3. If the product is defective, please stop using the product.
9.4. Repair or replacement of defective goods shall be mutually agreed upon by the online store and the Consumer. Repair costs are covered by the online store.
9.5. The online store is not responsible for defects in the product caused by the Consumer’s fault, which have arisen as a result of improper storage of the product or non-intended use of the product.
9.6. In the event of product non-compliance or defects, please send a complaint to the e-mail address firstname.lastname@example.org, where the name of the orderer, contact telephone number, order number and a precise description of the product’s non-compliance or defect are indicated.
9.7. A claim regarding the discovery of non-compliance or defects of the product must be submitted within two months from the discovery of the non-compliance or defect of the product.
9.8. All claims are reviewed and the Consumer is contacted as soon as possible, but no later than within 14 days of receiving the claim.
9.9. The consumer has the right to demand from the online store a reduction of the purchase price or to terminate the contract and to demand a refund for the goods, if the online store is unable to repair or replace the goods, the repair or replacement of the goods fails, the online store has not eliminated the lack of goods within a reasonable time, the consumer has been caused unreasonable inconvenience.
10.2. The sales contract between the Seller and the Customer enters into force from the receipt of the payable purchase amount to the Seller’s current account.
10.4. The seller has the right to cancel the order if the price of the Product displayed in the e-shop was incorrect due to a technical error.
11. Other Terms
11.1. If the e-store has refused to resolve the Consumer’s complaint or the Customer does not agree with the solution offered by the e-store and considers that his rights have been violated or his interests have been harmed, the Customer may submit a complaint to the Consumer Disputes Committee through the Consumer Protection Board or to the court. The consumer can file a complaint himself or through a representative.
