1.1. The conditions apply to the legal relationships between the person (hereinafter the Customer) and the owner of the shopping environment www.pharmalead.ee (hereinafter the e-shop) Medivar O\u00dc (hereinafter the Seller) when purchasing products via the e-shop.
1.2. In addition to these terms and conditions, the legal relationships arising from the purchase of products through the e-shop are regulated by the legislation in force in the Republic of Estonia.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

3. Forming the order<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

3.1. To order the goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate method of product delivery. The amount of the fee is then displayed on the screen, which can be paid securely through the following payment methods:

Payments are mediated by Montonio Finance O\u00dc. Payment takes place outside the Webshop in a secure environment – when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of Montonio Finance O\u00dc. The seller does not have access to the customer’s bank and credit card data. The contract enters into force from the receipt of the amount to be paid to the current account of the Online Store.

Medivar O\u00dc is the responsible processor of personal data and forwards the personal data necessary for making payments to the authorized processor Montonio Finance O\u00dc.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

4.1. Free delivery of www.pharmalead.ee e-store products to mailboxes within Estonia from a purchase amount of \u20ac50. Courier service within Estonia \u20ac5.59
4.2. Delivery time is 1-5 working days.
4.3. Products are delivered to the Customer by Smartpost, DPD or Post24 parcel machine, courier or Eesti Post registered letter.
4.4. The customer is obliged to check the correctness of the provided contact information before placing the order, in order to avoid delays and misunderstandings in the delivery of the products. The seller is not responsible for the delay in the delivery of the products and the misunderstandings that have arisen if the delay or misunderstanding is due to the inaccuracy or incorrectness of the data provided by the customer when placing the order.
4.5. The customer becomes the owner of the goods after paying for them.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

5. Right of return 14 days<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

5.1. The customer has a 14-day right of withdrawal from the contract (hereinafter 14-day right of return) for the goods purchased from the e-shop, in accordance with the terms of the contract below.
5.2. By purchasing from the e-store, the Customer agrees to the following conditions for using the right of return:
5.2.1. The product to be returned must be unused and in its original packaging (the customer must open the product’s original packaging carefully and without damaging it. If the packaging cannot be opened, the returned product does not have to be in its original packaging).
5.2.2 If the goods have been used for purposes other than what is necessary to verify the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.
5.2.3 To return the product, please fill out the withdrawal form. The application should be submitted to the address info@pharmalead.ee in order to agree on further actions. The product can be physically returned by contacting our office at Laki 30 in advance or using SmartPOST, DPD or Omniva parcel machines.
5.2.4 We will return the money for the returned product to the Customer’s bank account within 14 days of receiving the withdrawal statement. Return shipping costs are the responsibility of the buyer.
5.3. The 14-day right of return does not apply, among other things, to items that are not eligible for return for health protection or hygiene reasons, if the package has been opened after delivery (e.g. cosmetics, underwear and bikinis, face masks).
The 14-day right of return is stipulated by legislation and is not a special feature of the www.pharmalead.ee e-shop. You can read more about the right of return on the website of the Consumer Protection and Technical Supervision Board.
5.4. If the customer does not go to the parcel machine within the time specified (by the transport company) and the product is returned to the Seller, the customer must pay the postal fee again to receive the product again. When abandoning the goods, the part of the transport fee will not be refunded.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

6. Sales guarantee<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

6.1. Garantii andjaks on Medivar O\u00dc aadressiga Laki 30,\u00a012915, Tallinn.
6.2. Garantiist tulenevate \u00f5iguste kasutamiseks p\u00f6\u00f6rduda Medivar O\u00dc poole (pharmalead.ee info@pharmalead.ee; +372 6606070).
6.3. Garantii annab tarbijale \u00f5iguse n\u00f5uda m\u00fc\u00fcdud asja garantiis\u00a0etten\u00e4htud tingimustel tasuta v\u00f5i tasu eest parandamist v\u00f5i\u00a0v\u00e4ljavahetamist. Tasuta ei h\u00fcvitata garantii korras tooteid ja detaile,\u00a0mis on kulunud, l\u00f5hutud liigset j\u00f5udu kasutades, purunenud kukkudes\u00a0v\u00f5i saanud kahjustada tulenevalt mittesihtotstarbelisest kasutamisest.\u00a0Tasuta h\u00fcvitatakse tootjapoolse puudusega toote vastavusse viimine\u00a0lepingutingimustes etten\u00e4htuga. Puuduse tekkimise p\u00f5hjuse selgitab\u00a0v\u00e4lja tootja v\u00f5i m\u00fc\u00fcjapoolne asjatundja. Toote garantiisse saatmise\u00a0kulud h\u00fcvitab garantii andja.
6.4. Garantiist tulenevate \u00f5iguste kasutamiseks p\u00f6\u00f6rduda garantii\u00a0andja poole.
6.5. Garantii kehtib kaks aastat. Garantiit\u00e4htaeg algab asja ostjale\u00a0\u00fcleandmisest ning peatub ajal, mil ostja ei saa asja kasutada\u00a0lepingutingimustele mittevastavuse t\u00f5ttu, mille eest vastutab garantii\u00a0andja.
6.6. Garantii kehtib Eesti Vabariigis ja teistes Euroopa Liidu\u00a0liikmesriikides.
6.7. Lisaks garantiist tulenevatele \u00f5igustele on tarbijal ka muud\u00a0seadusest tulenevad \u00f5igused (nt kaebuse esitamise \u00f5igus V\u00d5S \u00a7-s\u00a0218 s\u00e4testatud tingimustel).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

7.1. The Seller and the Customer are responsible to each other for the damage caused to the other party by violating these terms and conditions in the cases and to the extent stipulated in the legislation in force in the Republic of Estonia.
7.2. The Seller is not responsible for damages caused to the Customer or for the delay in product delivery if the damage or the delay in product delivery is due to a circumstance that the Seller could not influence, did not foresee and could not foresee (force majeure).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Tarbija annab veebipoes andmeid sisestades ja vastava\u00a0kinnitusega \u00f5iguse koguda ja t\u00f6\u00f6delda Tarbija isikuandmeid (nimi,\u00a0kontakttelefon, paki k\u00e4ttetoimetamise ja\/v\u00f5i kodune aadress, e-postiaadress) ning edastada logistikapartnerile isikuandmeid kauba\u00a0kohaletoimetamiseks.
8.2. E-poel on \u00f5igus kasutada Tarbija elu- v\u00f5i asukoha aadressi\u00a0reklaami ja muu informatsiooni edastamiseks Tarbijale.
8.3. Tarbijal on igal ajal \u00f5igus keelata oma isikuandmete kogumine\u00a0ning kasutamine, v\u00e4lja arvatud juhul, kui see on vajalik lepingust\u00a0tuleneva n\u00f5ude sissen\u00f5udmiseks v\u00f5i kauba kohaletoimetamiseks.
8.4. Elektrooniliste isikuandmete kasutamine otsepostituseks toimub\u00a0ainult siis, kui Tarbija on selle jaoks andnud eraldi n\u00f5usoleku.
8.5. Kr\u00fcpteeritud andmeside pankadega ostude eest tasumisel tagab\u00a0Tarbija personaalsete pangatunnuste turvalisuse ja neile puudub ka\u00a0Veebipoel ligip\u00e4\u00e4s.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

9. Claim submission procedure<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

9.1. The online store is responsible for the non-compliance of the goods sold to the Consumer with the contract conditions or defects that appear within two years from the handing over of the goods to the Consumer. Within the first six months from the delivery of the item to the buyer, it is assumed that the defect was already present at the time of delivery of the item. It is the Webshop’s responsibility to refute the corresponding assumption.
9.2. In the event of a defect, the consumer has the right to contact the online store within two months at the latest, presenting the invoice on the basis of which the purchase of the goods was paid for.
9.3. If the product is defective, please stop using the product.
9.4. Repair or replacement of defective goods shall be mutually agreed upon by the online store and the Consumer. Repair costs are covered by the online store.
9.5. The online store is not responsible for defects in the product caused by the Consumer’s fault, which have arisen as a result of improper storage of the product or non-intended use of the product.
9.6. In the event of product non-compliance or defects, please send a complaint to the e-mail address info@pharmalead.ee, where the name of the orderer, contact telephone number, order number and a precise description of the product’s non-compliance or defect are indicated.
9.7. A claim regarding the discovery of non-compliance or defects of the product must be submitted within two months from the discovery of the non-compliance or defect of the product.
9.8. All claims are reviewed and the Consumer is contacted as soon as possible, but no later than within 14 days of receiving the claim.
9.9. The consumer has the right to demand from the online store a reduction of the purchase price or to terminate the contract and to demand a refund for the goods, if the online store is unable to repair or replace the goods, the repair or replacement of the goods fails, the online store has not eliminated the lack of goods within a reasonable time, the consumer has been caused unreasonable inconvenience.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

10.1. By making a purchase from the e-store, the Consumer agrees to the terms of use of the e-store and undertakes to comply with them.
10.2. The sales contract between the Seller and the Customer enters into force from the receipt of the payable purchase amount to the Seller’s current account.
10.3. The seller can change the terms of use of the e-store and the prices of the products. Notice of changes will be published in the e-shop environment. The conditions and prices valid at the time of the transaction are applied to the transaction.
10.4. The seller has the right to cancel the order if the price of the Product displayed in the e-shop was incorrect due to a technical error.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

If the e-store has refused to resolve the Consumer’s complaint or the Customer does not agree with the solution offered by the e-store and considers that his rights have been violated or his interests have been harmed, the Customer may submit a complaint to the Consumer Disputes Committee through the Consumer Protection Board or to the court. The consumer can file a complaint himself or through a representative.<\/p>
